A career in real estate is demanding and filled with many risks. The successful agent needs to identify the basic causes of risk, and design strategies for managing and minimizing these risks. This course provides an overview of real estate issues including misrepresentation, anti-trust, fair housing, disclosure, environmental law, agency and buyer representation, contract law and forms, and provides tools and tips for managing the risk in your real estate practice. This course will prepare you to:
• Specify the duties an agent owes to a principal for discovery and disclosure of material facts
• Limit liability for misrepresentations and potential antitrust violations
• Avoid unethical or illegal advertising terms or phrases
• Describe obligations of the seller/lessor/agent under enviromental laws
• Describe differences in the sales process when representing a buyer/seller
• Deal with conflicts that may arise when agency relationships have been created with both buyers and sellers
• Communicate clearly and effectively with buyers/sellers about contractual terms and issues
• Identify what you can and cannot do when preparing sales/listing agreements to avoid unauthorized practice of law
Students must attend the entire class and achieve a 70 percent on a written exam to be given at the end of the course.
